Terms and Conditions:

Please read the following terms and conditions carefully. 

By submitting your booking you are agreeing that you have read and understood these terms and conditions and you agree to enter in to a contract with Inward Adventures as detailed within these terms and conditions. 

Please contact us prior to completing the booking process if you have any questions or would like to discuss your needs, requirements or any details of the services you would like to book. Inward Adventures want to support you as best we can and we would love to talk to you before booking to ensure all issues are addressed prior to booking and attending an activity.

 

Definitions in these Terms and Conditions:

  • Daniel Claricoates is a registered sole trader, trading under a trading name, which is Inward Adventures.  

  • The Company / we / us / our / instructor(s) means Daniel Claricoates, instructors employed by Inward Adventures or Inward Adventures, 3 Tor View, Princetown, Yelverton, Devon, PL20 6RN.

  • The customer / you / your / they / their / participant(s) means the individual, the company or the organisation making and paying for the booking.

  • Services means the qualifications, products, courses or events delivered and provided by the company.

  • Contract means a contract between the customer and the company for the provision of services.

  • Terms and Conditions means these terms and conditions.

 

Application of these Terms and Conditions:

  • These terms and conditions shall form a contract and shall apply in place of and prevail over any terms and conditions contained or referred to in any communication from the customer or implied by custom or practice. Other terms and conditions are expressly rejected by the company.

 

Participation and safety:

  • The British Mountaineering Council Participation statement;

The BMC recognises that climbing and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions.

  • We support the British Mountaineering Council and its participation statement.

  • We recognise that services delivered carry a level of risk and / or possible injury and are often physically and / or mentally demanding and accidents can happen. 

  • While we take every care and make every effort to ensure the safety and wellbeing of all participants and staff, we ask all participants who take part in any services delivered by us, that they understand there can be a level of risk involved, accept the consequences of their own actions and to do their best to support and promote the safety of other participants and staff.

  • All instructors employed by the company and delivering services to the customer will have appropriate, in date qualifications and / or experience as well as correct insurances in place for the duration of the delivery of the service.

  • All bookings are accepted under the provision that the customer will abide by any safety instruction and guidance given by the company. 

  • Should the customer fail to abide by instruction and guidance the booking can be terminated without any warning and costs and / or fees will be forfeit. 

 

Health and wellbeing and Welfare:

  • Customers participating in services must expect to be involved in outdoor activities. These can be adventurous and also sometimes strenuous. Although prior experience and/or training is not always necessary to take part in the services, customers are expected to be in good general health. 

  • Outdoor activities take place in the outdoor environment that can pose many challenges including things beyond the companies control including the terrain and weather as well as many other factors.

  • Medical forms must be completed as part of the booking process and returned no later than 2 weeks prior to the commencement date of the service. 

  • All prior injuries and / or serious illnesses / disabilities must be declared. 

  • Any injury or illness occurring between the time of the declaration and the commencement of the course must be disclosed either before, or at the very least, the beginning of the service. 

  • The customer must be satisfied that taking part in the service is within their own capabilities. 

  • While we make every effort to ensure inclusion for all, the company reserves the right to refuse a booking on medical grounds if it is considered to be detrimental to the safety of the customer and other participants and staff.

  • We will make every effort in supporting disabilities and making services accessible and engaging. We request your disclosure as soon as possible in these instances and suggest open communication through out to ensure we can support you as best we can.

 

Consent and disclosure:

  • We ask that you provide a completed consent and medical form prior to taking part in any services delivered by us. 

  • The information collected includes information on medical conditions and treatments (including medications), disabilities and dietary requirements. 

  • The information collected will be used by staff to ensure the safety and wellbeing of all participants and to ensure no one is excluded from activities.

  • Any information disclosed to us by you will be held in strict confidence and held in accordance with GDPR. 

  • It will only be disclosed to emergency services in the event of an emergency or incident.

  • All participants under the age of 18 years old, must have the consent of a parent or legal guardian prior to taking part in an service delivered by us. Without one the under 18 participant will not be able to take part.

 

Bookings: 

  • We reserve the right, with absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances no contract is formed and we will return any payment accompanying the booking.

  • A contract will be formed and booking confirmed when the company acknowledges and accepts a customer’s completed booking form and required payment.

  • The contract is subject to availability of a service place/date and the acceptance by the customer of these terms and conditions.

  • A contract will be formed and booking confirmed for group bookings when the company acknowledges and accepts a customer’s completed booking form and a minimum of 50% non-refundable deposit is paid. Payment of said deposit must accompany the booking of a group.

 

Payments and Fees:

 

Scheduled and Private Courses and Events:

  • Places are only reserved once a completed booking form and full payment (or deposit when applicable) is accepted by the company.

  • Deposits (when applicable) are non-refundable.

  • The balance of payment is required no later than 4 weeks prior to the date of the commencement of services. If full payment is not received by the company by this time then the company will have the discretion to treat the booking as canceled by the customer. Any payment made to date would be forfeit.

  • The whole fee is payable If the booking is submitted within 4 weeks prior to the commencement date of the service.

  • For online bookings the whole fee is required to be paid upon booking unless otherwise agreed by the company prior to booking.

 

Group Courses and Events:

  • The balance of payment for group bookings is required no later than 4 weeks prior to the date of commencement of the services. If full payment is not received by the company by this time then the company will have the discretion to treat the booking as canceled by the group. Any payment made to date would be forfeit.

  • The whole fee is payable If the group booking is submitted within 4 weeks prior to the commencement date of the service.

Amendments by the customer:

  • Substitution of the original customer for another can be made provided at the original customer gives at least 1 weeks notice to the company, and the substituting customer satisfies the requirement of the course. 

  • All substitutions must be made with the consent of the company with both the substituted and substituting customer being jointly and severally liable for the total course fee.

  • All substituted customers must complete and return any required documentation, including consent and medical forms, before the company agrees substitutions. Documents must be returned at least 2 weeks of the commencement date.

  • Any outstanding costs and fees payable to the company must be settled 2 weeks before the commencement date of the service. If full payment is not received by the company by this time then the company will have the discretion to treat the booking as canceled. Any payment made to that date would be forfeit.

  • Group bookings: Variations in numbers must be agreed in writing and may incur additional fees and / or charges. No variations will be accepted within 2 weeks of the commencement date.

  • A customer may apply in writing, to change the service or the date of the service. This can be done providing the original booking is more than 30 days before the date of the original service.

  • Any application to change the service within the 30-day period will be dealt with under the terms and conditions relating to cancelation by the customer.

 

Cancelations:

 

By the customer:

  • All cancelations made by the customer must be made in writing and acknowledged by the company. Until the company acknowledge the cancelation the original booking is valid. 

  • The customer will be charged on the following basis.

  • All deposits are non-refundable.

  • If the customer cancels outside of 30 days before the commencement of the service date, no charge. All monies paid to date (except deposits) are refundable.

  • If the customer cancels within the 30 days before the commencement of the services date, 100% of the total of service payment. The customer will be liable to pay the full fee of the service(s) they had booked.

By the customer for group bookings:

  • If the group cancel outside of 30 days before the commencement of service date, no charge. All monies paid to date (except deposits) are refundable.

  • If the group cancels within the 30 days before the commencement of the services date, 100% total of the service payment. The group will be liable to pay the full fee of the service(s) they had booked.

By the company:

  • Whilst the company makes every attempt to ensure that services are delivered, the company may be required to cancel a service due to unsuitable conditions, course numbers or other issues outside of the control of the company.

  • The company will notify the customer of cancellation as soon as possible where it believes on reasonable grounds that cancellation is necessary due to dangerous and/or unsuitable conditions for the service.

  • The company shall notify the customer of potential cancellation not less than 5 days prior to the commencement of the service where numbers as a result of either customer(s) cancellation or booked numbers have failed to reach a workable minimum.

  • In the event of cancellation by the company, customers will be offered a choice from the following options:

  • Full refund of the fee paid; or

  • Another booking on a different date.

 

E-Gift Vouchers:

  • E-Gift vouchers can be purchased for values of £10, £25, £50, £75 and £100.

  • All gift vouchers are E-Gift vouchers are sent electronically. The purchaser and/or recipient will not receive a physical gift voucher.

  • A valid email address is required to purchase and receive an E-Gift voucher.

  • E-Gift vouchers ordered through the Inward Adventures website will be delivered to the email address specified at the time of ordering. Please ensure you check the email address is written correctly when ordering.

  • Inward Adventures can not be held responsible if somebody, other than the intended recipient, receives and uses the E-Gift voucher.

  • If you, or the intended recipient, have not received the E-Gift voucher please check the Spam folder. 

  • E-Gift vouchers are valid for 12 months from the date of purchase.

  • Any E-Gift voucher presented after the expiry date will be treated as expired and will not be accepted. It will be non-refundable and non-exchangeable.

  • E-Gift vouchers cannot be returned or refunded, and gift voucher orders cannot be cancelled except in accordance with your legal rights. 

  • E-Gift vouchers should be treated as cash, as we are unable to replace a gift voucher if lost or stolen. 

  • Inward Adventures reserve the right to refuse to accept an E-Gift voucher which it deems to have been tampered with, duplicated, damaged or which otherwise is suspected to be affected from fraud.

  • No change can be given for a gift voucher. If the value of the course or Adventure is lesser than the value of the gift voucher then the balance will be lost. Please consider this when purchasing the E-Gift vouchers and/or redeeming them.

  • Multiple gift vouchers can be used in the same transaction to the value of the products or services being purchased.

Loss or damage of personal effects and property:

  • Property belonging to the customer will be at all times the responsibility of the customer unless any loss or damage is due to any negligence by the company or its representatives.

  • During services, such as mindful retreats and digital detoxes, participants will be given the option to surrender their electronic items and effects. It is always the choice of the participant to do this and the company will take no responsibility for the items although the company will make every effort to secure and protect the items for the duration of the service. 

  • For specific services such as mindful retreats and digital detoxes participants are requested not to attend the service with electronic items. By doing so they understand they will not be allowed to use them for the duration of the service and any loss or damage of the items are their responsibility.

 

Advertising and delivery of services:

  • Course sizes described on the website are target sizes and may be increased or decreased at the discretion of the Company. The Company gives no undertaking as to the minimum or maximum size of a course but do undertake to ensure that Leaders, Guides, Instructors and support staff are supplied in appropriate numbers to ensure the principle outcomes of the service can be achieved. Similarly, Leaders, Guides, Instructors and support staff named in course descriptions, anywhere in the literature or on the website, may be changed at any time.

  • Neither the company website, nor literature constitutes an offer and the company may correct any errors or omissions to its published media including its prices at any time without warning.

  • All information is produced in good faith that it is accurate at the time of publishing.

  • Any current price list replaces all previous price lists.

Behaviour and conduct:

  • We reserve the right to exclude any participant from the planned activity if their actions are thought to endanger the safety of themselves or other participants. No refunds are available to anyone who is excluded. 

  • Anyone who acts in the contravention of the decisions or advice of the instructor or undertakes independent activities during the course will forfeit all professional protection and duty of care from the instructor.

  • Any damage caused to property and / or equipment due to unruly behaviour, will be billed for.

 

Force Majeure:

  • The company shall have no liability whatsoever in respect of any delay or failure in delivery of any of the services or of any of the company’s other obligations due directly or indirectly to any cause whatsoever outside the reasonable control of the company including but not limited to act of God, war, invasion, rebellion, riot, civil commotion, disorder, malicious damage, fire, flood, epidemic, quarantine restriction, strikes or other industrial disputes, unusually severe weather or energy supplies.

 

Liability:

  • The Company will not be liable where any failure in the performance of the Contract is due to: you; or a third party unconnected with the provision of the course and where the failure is unforeseeable or unavoidable or any other unusual and unforeseeable circumstances beyond the Company’s control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which the Company or its suppliers, even with all due care, could not foresee or forestall. The Company shall not be liable for any illness, injury or loss of life sustained on any course, except where such illness, injury or loss of life is caused by the negligence of the Company or its employees, nor will the Company be liable for any uninsured loss of personal property.

  • For all courses, you are advised to have insurance that covers you for all of the activities.

 

Freelance Terms and Conditions:

  • Terms and conditions for freelance work and support are available upon request.

  • Any freelance work will be discussed and terms and conditions for the work agreed by both Daniel Claricoates and the potential employer prior to any work taking place.

Covid 19:​

​

Covid 19 symptoms and your attendance:

  • If you are experiencing any symptoms of Covid 19 we ask you do not attend the course or Adventure you have booked. Instead, please contact us and we will offer you either alternative dates or a refund. 

Cancelations by the customers:​

  • Late cancelations due to Covid 19 will not occur any penalties. 

Cancelations by the company:​

  • We reserve the right to late cancelation of any course or Adventure due to Covid 19. If this situation happens we will offer either alternative dates or the refund of any monies paid. 

PPE and hand sanitisers.​

  • We ask participants to bring with them the following items to help prevent the spread of Covid 19.

    • A suitable face covering​.

    • Enough hand sanitiser for the duration of the course or Adventure.

Feedback and reporting:​

  • We will ask you to let us know at the fist possible opportunity of any changes to your health with regards to Covid 19 up to 14 days after the end of your course or Adventure.

  • We will email you and ask if you are experiencing any symptoms 14 days after the end of your course or Adventure.

  • We will contact you directly if we believe you have been exposed to Covid 19 on any of our courses or Adventures.
